1. Introduction

Welcome to DemoPolish! These Terms of Service ("Terms") govern your access to and use of the DemoPolish service, including our websites at demopolish.com and app.demopolish.com (collectively, the "Service"), operated by Kayra LLC ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access the Service. If you have questions, please contact us at hello@demopolish.com.

2. Definitions

  • Account means a registered user account that allows you to access the Service.
  • Content means any videos, recordings, text, images, or other materials you upload, submit, or create using the Service.
  • Device means any computer, smartphone, tablet, or other electronic device used to access the Service.
  • Subscription means a paid plan that grants access to Service features on a recurring basis.
  • User means any individual who accesses or uses the Service.

3. Service Description

DemoPolish is a video processing service that transforms screen recordings into polished demo videos with AI-generated voiceovers. The Service processes your uploaded recordings to:

  • Smooth cursor movements and transitions
  • Generate professional AI voiceover narration
  • Produce downloadable polished demo videos

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. Account Registration

To use certain features of the Service, you must create an Account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your Account
  • Notify us immediately of any unauthorized access or security breach

You may register using your email address or through Google Sign-In. You must be at least 16 years old to create an Account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Technical Requirements

To use the Service, your Device must meet the following minimum requirements:

  • Internet connection
  • Modern web browser (Chrome, Firefox, Safari, or Edge) updated within the last year
  • JavaScript enabled

6. Subscriptions and Billing

The Service offers paid Subscription plans. By subscribing, you agree to the following:

  • Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.
  • Automatic Renewal: Your Subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
  • Payment Method: You must provide a valid payment method (credit card, debit card, or other accepted method). You authorize us to charge your payment method for all fees incurred.
  • Price Changes: We may modify Subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

You can cancel your Subscription at any time through your Account settings or by contacting us at hello@demopolish.com. Cancellation takes effect at the end of the current billing period.

7. Refunds

We offer a 30-day money-back guarantee for all paid Subscriptions. If you are unsatisfied with the Service, you may request a full refund within 30 days of your initial purchase by contacting us at hello@demopolish.com. Refunds are processed to the original payment method. After the 30-day period, paid fees are non-refundable except where required by law.

8. Your Content

You retain full ownership of all Content you upload to the Service. By uploading Content, you grant us a limited license to:

  • Process, transform, and store your Content to provide the Service
  • Create derivative works (processed videos) as requested by you

You represent and warrant that:

  • You own or have the necessary rights to your Content
  • Your Content does not infringe on any third party's intellectual property or privacy rights
  • Your Content complies with all applicable laws and regulations
  • You are responsible for any personal or sensitive information included in your Content

9. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Exploit, harm, or attempt to harm minors
  • Transmit spam, chain letters, or unsolicited promotional materials
  • Impersonate any person or entity, or misrepresent your affiliation
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated tools (bots, scrapers, etc.) without our permission
  • Introduce viruses, malware, or other harmful code
  • Circumvent any security measures or access controls

We reserve the right to terminate your Account immediately if we determine you have violated these prohibited uses.

10. Intellectual Property

The Service, including its original content, features, functionality, design, and branding (excluding your Content), is owned by Kayra LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

11. Third-Party Links

The Service may contain links to third-party websites or services not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You access third-party sites at your own risk.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAYRA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

We are not liable for the accuracy or quality of AI-generated voiceovers or processed video outputs. The AI-generated content should not be relied upon as professional advice.

14. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. We may suspend or restrict access to the Service for maintenance, updates, or circumstances beyond our control. We will provide advance notice when possible for planned maintenance. By using the Service, you acknowledge that 100% uptime is not guaranteed.

15. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement reasonable security measures but cannot guarantee absolute security of your data.

16. Confidentiality

Both parties agree to treat any non-public information exchanged in connection with the Service as confidential. This includes business data, technical details, and proprietary information. Confidential information shall not be disclosed to third parties without prior written consent, except where required by law or necessary to provide the Service.

17. Termination

We may terminate or suspend your Account immediately, without prior notice, if you:

  • Breach any provision of these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees

You may terminate your Account at any time by discontinuing use of the Service or contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

18. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date and may notify you via email or through the Service for significant changes. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kayra LLC regarding the Service and supersede any prior agreements or understandings.
